Why Your Agent Loses Money When You Negotiate a Lower Price — And How That Costs You

Your buyer agent earns a percentage of the sale price. Every dollar they negotiate down costs them money. A flat-fee agent has no such conflict — their fee stays the same whether you pay $850,000 or $900,000.

Three Things to Check in Your Buyer-Broker Agreement

Since the NAR settlement took effect in August 2024, buyers must sign a buyer-broker agreement before touring homes. Before you sign:

  1. Is the fee a percentage or flat amount? If percentage, your agent earns more when you pay more.
  2. Can you terminate without penalty? Some agreements lock you in for months.
  3. Does the agreement specify which services are included? A managing broker's oversight should be standard, not extra.

Why This Matters More Than You Think

As cited by NPR, USA Today, and the New York Post, the NAR settlement has fundamentally changed how buyer agent fees work. Buyers now have a choice. They can pay a percentage that penalizes their own negotiating success. Or they can pay a flat fee that stays the same no matter what.
